1. How do I file a garnishment?

After you obtain a judgment, you can go to the Clerk’s office and file either a wage or non-wage garnishment. You must know where the person works or what non-wage source you are going to attach.

2. How much does it cost to file a garnishment in Municipal Court?

$83.00 for a wage garnishment
$59.00 for a non-wage garnishment.

3. What is the federal hourly minimum wage?

4. What is a garnishment hearing?
|
|
If you dispute a garnishment because you feel that whatever was attached is exempt or was improperly attached for some reason, you may request a hearing to have the magistrate decide if the garnishment is proper. NO OBJECTION TO THE JUDGMENT ITSELF WILL BE HEARD OR CONSIDERED AT THE GARNISHMENT HEARING.

5. I found out that I have a default judgment against me. How do I fight it?

File a motion to set aside the default judgment at the Clerk’s office (form available here).

6. A lien, or judgment, showed up on my credit report. How do I get that off?
|
You will have to pay off the judgment, plus any interest or costs. First, contact the attorney if there is one, or the judgment creditor. Once the judgment is paid, the plaintiff, or attorney, will then put on an entry of satisfaction. The defendant will have to get a certified copy of the entry of satisfaction, cost $1.00, and send it to the credit bureau. If you cannot contact the plaintiff or the attorney, you may pay the judgment and costs to the clerk, CASH ONLY.

7. How do I file a Trusteeship?
|
|
First of all, there must be a pending garnishment against you to get into the program. Bring in the most recent copies of your bills, with the creditor’s address, the amount, and the account number, and two of your most recent paycheck stubs. You will then fill out an application ($50.00 filing fee), and you will have to go to court on the same day as you fill out the application. If you are accepted into the program your payments will represent 25% of your net pay for a month. Payments will be made monthly. Payments received will then be disbursed to your creditors on a quarterly basis.
